The concept of Origin in Importation, what is not?
What is the concept of origin?
Anyone who is closely related to foreign trade has heard of this concept.
Turkish Language Association He describes it as "the beginning, the place where something comes out, the origin, the source, the cause."
According to our customs law, the goods obtained or produced entirely in one country are of that country's origin. In order for the goods made in more than one country to be considered to be of a country's origin, a new product must be manufactured in that country, or an important stage of manufacturing, and the latest essential labour and action deemed economically necessary, must be carried out in enterprises equipped for that purpose in that country.
Depending on the origin of the item subject to trade, i.e. which country is to be considered to be sourced, different import conditions can be determined. Our country can unilaterally or on the basis of reciprocity, some countries may subject the free movement of items of origin to other financial obligations, such as trade policy measures, additional customs tax, or additional financial liability.
In order to ensure that the item is not subject to the additional measures set forth above for certain countries or groups of countries, it is referred to as the "Menshe Şahadetna" which is regulated by the competent authorities of the country of origin or the exporting country to document that the country is not of origin or that the changes and transactions it sees in another country are not to be considered to be of that country.
In the event that this document is not submitted to customs in import or is not in accordance with customs in terms of form or content, other financial obligations such as origin-based trade policy measures, additional customs tax or additional financial liability shall be tied to the cash guarantee, giving the importer a six-month period from the date of registration of the declaration for the submission of a proper source testimony. If it is in the form of a formal decree of origin, the guarantee will be returned.
The Concept of Origin and its Importance in Importation
Non-commercial and CIF For the item whose value does not exceed 430 Euros, there is no need for a citation of origin.
The above-mentioned provisions are regulated in Articles 17 to 21 of the Customs Act and are provisions relating to the non-preferential origin of the item. Apart from preferential tariff implementations, it is conducted for the purpose of implementing measures created by the Resolution of the Council of Ministers.
In the event that documents are submitted (EUR.1, EUR.MED, Invoice Statement, EUR.MED Bill Statement, Form A, etc.), which imposes the preferential origin of the item in order to benefit from the preferential tariff application that Turkey has recognized as a single party within the framework of agreements with some countries or groups of countries, or in order to benefit from the preferential tariff application. However, one very important issue here is that the Mentionation of Origin, which is sought under the provisions of non-preferential origin, is not to be confused with the documents taken under preferential tariff practices and the areas of application.
The acceptance of a proof of origin, which indicates the preferential origin of the item, rather than the Testament of Origin, is only possible if an item brought in order to take advantage of the preferential tariff under a preferential trade is also subject to a trade policy measure.
