Changes in the Time of Importation of Export Fees
In the Circular, which regulates the procedures and principles for bringing export prices into the country, amendments were made to the Treasury and Finance Ministry's article dated 03.08.2023 and numbered 2358545.
The change will not be subject to the prefinancing provisions of the "50,000, – the US dollar or the part of the currency not exceeding the equivalent of the Turkish lira", which is not fully returned at one time or whose exports are not carried out within the period.
The current state of the relevant substance is as follows.
5/(2) This amount is subject to prefinancing loan provisions in terms of the exchange legislation, provided that no exports are made within 24 months or at the end of the additional period given in accordance with the first paragraph, or that the entire amount of the advance currency is not returned at once within that period. However, the amount of the advance foreign currency, which is not all returned at once or whose exports are not carried out within the period, is not subject to the provisions of the prefinancing of the amount of $50,000,- US dollars, or the portion of the currency not exceeding the equivalent of the Turkish lira. The Ministry shall not be notified by the banks which ensure that legal action is initiated under the Law on the Protection of the Value of Turkish Currency No. 1567 on the issue of cash exchange. In addition, it is possible to have justified reasons such as discount, discount or deterioration of goods before 24 months are completed, and to return the amount of the amount deposited in advance if this situation is transferred to the bank where the advance price is transferred/received by the exporter and the change in the exact sales invoice. In the case of partial refunds other than this, the advance price in question is subject to the prefinancing provisions on the date of the partial refund. Partial or not, it is only possible for the Bank to refund the advance price to the person who made the transfer. The provisions of the KKDF legislation regarding the return of the advance price are reserved.
